These Terms & Conditions govern access to the Sandy Shells website, direct enquiries, booking requests, confirmed reservations and guest stays at the Sandy Shells beachfront penthouse suites at Sandy Shores, Kikambala. By using the website, submitting an enquiry, making a booking, paying a deposit or staying at the property, the guest agrees to these terms.

This page is provided for guest clarity and should be read together with the booking confirmation, invoice, house rules and any written instructions shared by Sandy Shells.

These terms are intended to be governed by the laws of Kenya.

1. Parties and Definitions

"Sandy Shells", "we", "us" or "our" refers to the property owner/operator, operating the Sandy Shells Kikambala accommodation experience at Sandy Shores, Kikambala, Kilifi County, Kenya.

"Guest", "you" or "your" refers to the person using the website, making an enquiry, submitting a booking request, paying for a reservation or staying at the property, including any person included in the booking.

"Property" refers to the Sandy Shells beachfront penthouse suites, their rooms, balconies, furniture, appliances, fixtures, allocated parking, shared facilities and any common areas guests are permitted to use.

"Booking" means a reservation request or confirmed reservation for accommodation, whether made through the website, WhatsApp, telephone, email, social media, direct invoice or any authorised booking channel.

"Written confirmation" includes email, website confirmation, WhatsApp message, SMS, invoice, receipt or other written communication issued by Sandy Shells or its authorised representative.

2. Acceptance of These Terms

You accept these terms when you access the website, submit an enquiry, create an account, make a booking request, pay a deposit, pay a balance, check in, or allow another guest in your party to use the property.

If you make a booking on behalf of other guests, you confirm that you are authorised to act for them and that you will make them aware of these terms, the Privacy Policy, the Cancellation Terms and the house rules.

If you do not agree with these terms, you should not use the website, submit a booking request, make payment or stay at the property.

3. Website Use

The website is provided to help guests view accommodation information, amenities, images, prices, availability, policies, contact details and booking options.

You must not misuse the website, attempt unauthorised access, interfere with website security, submit malicious code, scrape content at scale, overload the system or use the website for unlawful, fraudulent or misleading purposes.

Website content is provided for general booking information. While we aim to keep information accurate and current, photographs, descriptions, amenities, availability, pricing and promotional details may be updated from time to time.

We may suspend or restrict website access for maintenance, security, technical upgrades or operational reasons without liability, provided we act reasonably.

4. Booking Requests and Confirmation

Submitting a booking request does not automatically guarantee availability or create a confirmed reservation. A booking is confirmed only when Sandy Shells accepts the booking and receives the required deposit, full payment or written payment commitment requested for that booking.

Sandy Shells may decline or cancel a booking request if the property is unavailable, payment is not received on time, guest information is incomplete, suspected fraud is identified, occupancy limits would be exceeded, or the request conflicts with these terms or house rules.

You must check the booking dates, apartment type, number of guests, price, payment details, arrival information and cancellation terms before paying. Notify Sandy Shells immediately if any confirmation details are incorrect.

Special requests, including early check-in, late check-out, specific sleeping arrangements, additional cleaning, decorations, events or accessibility-related needs, are not guaranteed unless accepted in writing.

5. Guest Information and Eligibility

The lead guest must be at least 18 years old and capable of entering into a binding booking arrangement.

Guests must provide accurate names, contact details, guest numbers, arrival details, payment references and any other information reasonably required to manage the booking and comply with applicable law.

Sandy Shells may request identification at check-in or before arrival for security, fraud prevention, property protection or legal compliance. Failure to provide reasonably requested information may result in refusal of check-in or cancellation.

The lead guest is responsible for the conduct, payments, damages, losses, rule breaches and obligations of all guests, children, visitors and invitees associated with the booking.

6. Rates, Taxes, Fees and Promotions

Rates may vary depending on apartment type, season, length of stay, number of guests, public holidays, special events, demand, promotions and booking channel.

The applicable rate is the rate confirmed in writing for your booking. A rate seen earlier on the website or another channel may not remain available if availability, dates, promotions or booking details change.

Unless stated otherwise, rates are for accommodation only and may exclude refundable deposits, cleaning fees, service fees, government taxes, transaction charges, extra guest fees, special requests, transport, meals, tours or other add-ons.

Promotional offers are subject to the stated conditions, availability, booking period, stay period and payment deadlines. Promotions cannot be combined unless Sandy Shells confirms this in writing.

7. Payments and Payment References

Payment methods may include M-Pesa, bank transfer, card payment, cash deposit or another method confirmed by Sandy Shells. The available methods may change depending on operational requirements.

A booking may require a deposit, partial payment, full prepayment or balance payment before arrival. Payment deadlines will be shown on the website, invoice, booking confirmation or written communication.

The guest must use the correct payment account, pay bill, till number, reference, invoice number or booking code supplied by Sandy Shells. If a wrong reference, wrong amount or wrong account is used, the booking may remain unconfirmed until the payment is traced and verified.

Bank, mobile money, card, currency conversion, chargeback or third-party payment charges are the guest's responsibility unless Sandy Shells expressly agrees otherwise.

Sandy Shells may cancel or release a pending booking if required payment is not received by the stated deadline.

8. Security Deposit, Damage and Loss

Sandy Shells may require a refundable security deposit before or at check-in. The amount, payment method and refund timeline will be confirmed during booking if applicable.

The guest is responsible for damage, breakage, missing items, excessive cleaning, stains, misuse, lost keys, unauthorised access devices, smoking damage, blocked drains caused by misuse, appliance damage, linen damage and any loss caused by the guest, visitors or invitees.

Reasonable repair, replacement, cleaning, locksmith, administrative or recovery costs may be deducted from the security deposit or charged separately if they exceed the deposit amount.

Guests must report any pre-existing damage or missing item as soon as possible after check-in, preferably with photographs, to avoid responsibility for damage not caused by them.

9. Check-In, Check-Out and Access

Standard check-in and check-out times will be communicated during booking. Early check-in and late check-out depend on availability, cleaning schedules and written approval.

Guests must follow the arrival instructions, access procedures, security requirements and estate or building rules applicable at Sandy Shores.

Keys, access cards, remotes and entry codes must be kept secure and returned as instructed. Lost or damaged access items may be charged to the guest.

Sandy Shells may refuse check-in or require guests to leave if they are abusive, intoxicated in a way that creates risk, threatening, violent, suspected of fraud, exceeding occupancy limits or unwilling to comply with reasonable security and property rules.

10. Occupancy, Visitors and Events

The maximum occupancy stated for the apartment must not be exceeded without prior written approval. Children, infants, overnight visitors and domestic staff may count toward occupancy unless Sandy Shells confirms otherwise.

Only registered guests may stay overnight. Day visitors may be restricted by property rules, security rules, estate rules or Sandy Shells' approval.

Parties, commercial events, paid gatherings, photo shoots, filming, product activations, loud celebrations or group events are not allowed unless Sandy Shells approves them in writing and may be subject to additional fees, deposits and conditions.

If unauthorised guests, visitors or events are discovered, Sandy Shells may charge additional fees, cancel the stay, require guests to leave, retain part or all of the security deposit and recover any resulting loss.

11. House Rules and Guest Conduct

Guests must use the property respectfully, keep noise at reasonable levels, respect neighbours, comply with estate rules, avoid nuisance and maintain a safe environment for themselves and others.

Smoking, vaping, shisha, candles, incense, open flames, illegal drugs, weapons, unlawful activity, tampering with safety equipment and conduct that creates fire, security or health risks may be prohibited or restricted.

Guests must keep doors, windows and balconies secure when away, switch off appliances where safe to do so, use air conditioning and electrical items responsibly and avoid overloading sockets.

Pets are not allowed unless Sandy Shells gives prior written approval. Approved pets may be subject to additional cleaning fees, deposits and conduct rules.

Sandy Shells may issue reasonable instructions during a stay to protect guests, staff, the property, neighbours, shared amenities or legal compliance. Guests must comply promptly.

12. Shared Facilities, Pool, Beach and Amenity Use

Use of pools, gym, water slides, beach access, parking, lifts, corridors, security gates and other shared facilities may be subject to Sandy Shores management rules, opening hours, age restrictions, safety rules and availability.

Guests use beach, ocean, pool, gym and water-related facilities at their own risk and must supervise children and vulnerable persons at all times.

Sandy Shells does not guarantee uninterrupted access to shared facilities where interruption is caused by maintenance, weather, safety restrictions, power issues, management decisions, third-party rules or events beyond its reasonable control.

Guests must not remove property items such as towels, linen, kitchenware, decor, electronics or furniture from the apartment unless expressly permitted.

13. Cleaning, Maintenance and Property Access

Cleaning arrangements, linen change frequency and housekeeping availability will be communicated during booking or check-in. Additional cleaning may attract extra charges.

Sandy Shells or authorised personnel may access the property on reasonable notice for cleaning, maintenance, inspection, emergency response, guest support, safety checks or suspected breach of these terms.

In an emergency, suspected security issue, water leak, fire risk, serious disturbance or urgent maintenance matter, Sandy Shells may access the property without prior notice where reasonably necessary.

Guests must report maintenance issues promptly and allow reasonable access for inspection or repair. Failure to report a problem may increase guest responsibility if the problem worsens.

14. Images, Descriptions and Availability of Amenities

Images and descriptions are intended to represent the property and guest experience accurately, but layout, decor, furniture, views, appliance models, finishes and amenities may change due to maintenance, replacement, improvement, wear and tear or operational reasons.

A temporary failure of a non-essential amenity does not automatically entitle the guest to a refund if Sandy Shells takes reasonable steps to repair, replace, provide an alternative or otherwise address the issue.

Where a material amenity becomes unavailable before check-in and Sandy Shells is aware of it, we will make reasonable efforts to inform the guest and discuss suitable options.

15. Cancellations, Date Changes and No-Shows

The separate Cancellation Terms form part of these terms and apply to guest cancellations, date changes, no-shows, early departures, refunds and booking credits.

If a booking was made under a special non-refundable offer, discounted package, long-stay arrangement or third-party channel, the stricter or more specific cancellation rule may apply if it was disclosed before payment.

Sandy Shells may cancel a booking where required by safety, property damage, emergency repairs, legal restrictions, force majeure, suspected fraud, non-payment or serious breach. Where cancellation is not caused by the guest, Sandy Shells will act reasonably to offer a refund, credit or alternative date depending on the circumstances.

16. Guest Complaints and Issue Resolution

Guests must report concerns as soon as possible during the stay so Sandy Shells has a fair opportunity to investigate and resolve the issue.

Complaints made only after check-out may be harder to verify and may not qualify for compensation if the guest did not give Sandy Shells a reasonable chance to address the issue during the stay.

Any agreed refund, credit, partial adjustment or goodwill gesture must be confirmed in writing by Sandy Shells.

17. Liability and Limitations

Sandy Shells will provide the accommodation with reasonable care and skill, but it is not liable for losses caused by the guest's own acts or omissions, third-party service providers, shared-facility management decisions, weather, power outages, internet interruptions, public utility failures, government action, beach conditions or events beyond reasonable control.

Guests are responsible for safeguarding personal belongings, valuables, travel documents, money, electronics and vehicles. Sandy Shells is not responsible for loss or theft unless directly caused by proven negligence of Sandy Shells or its authorised staff.

Nothing in these terms excludes liability that cannot lawfully be excluded under Kenyan law.

18. Force Majeure

Sandy Shells will not be responsible for failure or delay caused by events beyond reasonable control, including severe weather, flooding, fire, civil unrest, government restrictions, public health emergencies, utility failures, internet outages, security incidents, labour disruption, building-management action or unavoidable emergency repairs.

Where a force majeure event materially affects a confirmed stay, Sandy Shells will act reasonably and may offer rescheduling, credit, partial refund or cancellation depending on the nature of the event and costs already incurred.

19. Privacy and Data Protection

Sandy Shells collects and uses guest information for enquiries, bookings, payments, guest support, security, legal compliance and service improvement. The separate Privacy Policy explains how personal data is handled.

By submitting information through the website, WhatsApp, email, phone or another booking channel, you confirm that the information is accurate and that you have authority to provide information about any guests included in your booking.

20. Intellectual Property

The Sandy Shells name, website content, images, videos, text, layout, design elements, logos, graphics and marketing materials belong to Sandy Shells or its licensors unless stated otherwise.

You may view and share website links for personal booking purposes, but you may not copy, reuse, reproduce, sell, modify or commercially exploit Sandy Shells content without written permission.

21. Amendments

Sandy Shells may update these terms from time to time. The version published on the website or provided at the time of booking will generally apply to that booking unless a legal or operational change requires immediate update.

Material changes that affect an existing confirmed booking will be communicated where reasonably practical.

22. Governing Law and Dispute Resolution

These terms are intended to be governed by the laws of Kenya.

The parties should first attempt to resolve any dispute through good-faith discussion. If the dispute cannot be resolved informally, it may be referred to mediation, arbitration, a competent court or another lawful dispute resolution process agreed by the parties.

Sandy Shells' failure to enforce a term immediately does not waive its right to enforce that term later.
